Under the domain https://servers4gamers.com operates SURAMAR OÜ (Reg code: 16180582, Juhkentali tn 8 Tallinn Harjumaa 10132). On the website, customers ("You","Customer") can rent multiplayer game servers on a regular subscription basis. All services of the provider will be referred to in the regulations as the "Service". The purpose of the Service is to provide the client with a technical platform for the administration of the game server and the possibility of using this Service by means of telecommunications.
The agreement governs the relationship between Suramar OÜ and the customer.
The agreement does not have to be signed in writing.
1.1 Prior customer registration is required to use the services. The customer ensures that all information provided by him is true and complete. Registration using third party data is prohibited.
1.2 User registration requires name, surname, e-mail address, telephone number, billing address and password.
1.3 By registering for and using the service, you agree to the Terms of Service.
1.4 The password provided during registration must be kept for personal use only and kept secret. The customer is responsible for any use (including unauthorized use) of his password. You will notify the Servers4Gamers customer service team if your password is lost or stolen, or if you believe there has been unauthorized access to your account.
1.5 Our service is aimed at adults. By using the server services, you confirm that you are eighteen (18) years of age or older. Persons under the age of eighteen (18) may not use the server services.
2.1 The client gets full access to the server and takes full responsibility for it. Resale of the service previously purchased by the Customer is strictly prohibited.
2.2 The customer may install and use legal software on his game server, provided that it does not violate copyright, related rights, intellectual property rights and applicable law. The customer is obliged to verify the hosted materials and software on the server and is responsible for their compliance with copyright, related rights, intellectual property rights and the standards of applicable law.
2.3 The customer may use his server for purposes consistent with applicable law, ethical and moral standards. More information in chapter 3.
2.4 The customer is fully responsible for his public statements and actions against Suramar OÜ.
2.5 The customer has the right to report any problems related to server performance through the Servers4Gamers service ticket system.
The server services may only be used for the purposes specified by Suramar OÜ. By accepting our Terms of Service, you confirm that you will only use the server services for lawful purposes.
Suramar OÜ reserves the right to disable the server or terminate the service by any customer or end-user activity that exposes Suramar OÜ to legal liability.
Suramar OÜ reserves the right to block the server or discontinue the service at its sole discretion, immediately and without notice in case of violation of the following rules.
In the event of gross abuse by the customer or end user, Suramar OÜ reserves the right to provide the necessary information to law enforcement authorities. More information in our Privacy Policy.
3.1 List of prohibited behaviors:
3.1.1 It is prohibited to store illegal content on the disk space made available to the user.
3.1.2 It is prohibited to distribute unlawful, pornographic, or other sexual content through the communication features of the server.
3.1.3 It is prohibited to call for extremist, terrorist, racist, violent, discriminatory, child-harmful behavior through the communication features of the server.
3.1.4 It is prohibited to incite to commit a crime or provide identical instructions through the communication features of the server.
3.1.5 It is prohibited to commit or attempt to commit fraud through the use of mechanisms, software or scripts in connection with the use of the service.
3.1.6 It is prohibited to impersonate any person with forged headers or other identifying information.
3.1.7 It is prohibited to use the services to transmit slander and any material that harass others.
3.1.8 It is prohibited to use the services to disseminate personal data.
3.1.9 It is prohibited to perform actions (e.g. unauthorized distribution or copying of software) that violate copyright, related rights and intellectual property rights when using the service.
3.1.10 It is prohibited to use the server service to make fraudulent offers to sell or buy products, items or services, or to carry out any type of financial fraud, such as "pyramid schemes" and "chain letters".
3.1.11 It is prohibited to spoof the IP address, email address or header.
3.1.12 It is prohibited to perform phishing and identity theft through the communication features of the server.
3.1.13 It is prohibited to transmit any material that encourages bodily injury or property damage through the communication features of the server.
3.1.14 It is prohibited to deliberately or recklessly cause a failure, hinder the stable operation of servers and network resources (outgoing and incoming DDOS).
3.1.15 It is prohibited to host IRC services.
3.1.16 It is prohibited to manipulate the server services as well as the accompanying software and programs.
3.1.17 It is prohibited to host an open proxy, open VPN and other public services that can help with illegal activities on the Internet.
3.1.18 It is prohibited to host software for mass mailing, spam, messaging, etc.
4.1 Suramar OÜ guarantees 99% server availability throughout the year. Availability statistics created by external analyzers are made available to customers on the Servers4Gamers website at the discretion of the Company.
4.2 In the event of a breach of clause 4.1, the customer will be compensated by a subscription to our services. Each day (24 hours) of downtime will be compensated with an additional three (72 hours) days of access to server services. The Company is not liable or obliged to provide compensation in the event of fortuitous events described in point 5.1.
4.3 Suramar OÜ guarantees the compliance of the allocated server resources with the information provided on the site.
5.1 Unavailability of servers at the declared level in the event of the following random events:
5.1.1 Temporary difficulties due to technical, maintenance, testing or updating issues.
5.1.2 DDoS attack or other network attack.
5.1.3 Power, hardware, software failure or telecommunications disruption.
5.1.4 Temporary unavailability of internet or other services due to acts or omissions of government authorities and other third parties.
5.1.5 Other random events beyond the control of the Company, such as power grid failure, natural disaster, war, riots, uprising, epidemic, strikes, terrorist activities or other large-scale events.
5.2 Monitoring content on the client's server, except to receive a legitimate third party complaint.
5.3 Installed client software, server configuration and the consequences this may cause.
5.4 Inadvertent disclosure of confidential or other information.
5.5 Malicious or fraudulent actions of third parties resulting in hindering the provision of the Company's services, damage to the Company's equipment, theft and damage to the Customer's information.
6.1 The Company reserves the right to change the Terms of Service at any time without prior notice. The new regulations will come into force as soon as they are made available on the Servers4Gamers website.
6.2 The company does not guarantee 100% server uptime.
6.3 The company reserves the right to temporarily stop the client's servers due to random events. More information in section 5.1.
6.4 The Company undertakes to maintain the appropriate quality of host computers.
6.5 The company undertakes to remove all defects as soon as possible.
6.5 The Company undertakes to perform all scheduled maintenance and upgrades between 23:00-05:00 CET. We reserve the right to carry out urgent maintenance due to a sudden failure outside of the stated hours.
6.6 The company offers free technical support to Servers4Gamers customers as part of subscription services.
6.7 The company is responsible for the availability of the resources purchased by the customer.
6.8 The company reserves the right to block the client's server if the client does not respond to the complaint or if the client causes a significant network load.
6.9 The company reserves the right to block the client's server in case of incoming DDoS attacks.
7.1 The company provides a three (3) day money back guarantee, also for recurring payments.
7.2 The Company provides a full seven (7) day money back guarantee if the services are found to be defective.
7.3 Any service purchased with a promotional code is non-refundable.
8.1 The customer has the right to resign from the service at any time using the form available on the website of the Servers4Gamers service. The service will be active until the end of the billing period. If you require immediate cancellation of the service, please contact customer service. A cancellation request does not guarantee a refund - the refund is subject to the rules described in chapter 7.
8.2 The contract may be terminated before the expiry of the initial period if the Company fails to provide the service in accordance with the terms of the contract or does not remedy the defect within seven (7) days.
9.1 Subject to your compliance with the Terms of Service, Suramar OÜ will grant you limited permission for personal, non-commercial use of the server services. Access remains in effect until expired or terminated by Suramar OÜ. You may not redistribute, transfer or share the server services.
10.1 The service is provided upon payment of 100% advance payment.
10.2 We use the Stripe online payment system to process payments. By making a payment for the service, you consent to the processing of your personal data by the payment processor. More information in Privacy Policy.
10.3 7 days before the end of the server rental, the customer will receive an invoice by e-mail.
10.3.1 In the absence of payment for the service before the end of the server rental period, the server will be blocked for 72 hours.
10.3.2 The payment deadline is counted from the date of blocking the server, not from the date of receipt of the new payment.
10.3.3 Data on a blocked server will be stored for 72 hours. This is the time to pay the outstanding invoice. If the invoice is not paid within this time, all data on the server will be deleted after 72 hours.
10.3.4 Customers can enable automatic renewal of server subscriptions. This means that on the first day of the new billing period, the system will automatically collect payment for the previously issued invoice with predefinied Credit Card payment method.
10.4 Suramar OÜ may increase service fees with effect from the first day of the next billing period. The customer will be informed about an increase in service fees at least 14 days in advance. Failure to cancel the subscription by the customer constitutes acceptance of the new terms of the contract.
